Trial Preparation Slowing Down My Post Election Posts
I apologize for the dearth of post election posts. I have been
preparing for trial that starts next week in our efforts to reform our
local homeowners association.
Our efforts so far have gone very well. In September, Visiting
Judge Richard Markus stated that he did not believe that the Apple
Valley Property Owners Association (AVPOA) board had just cause to
remove my wife, Kathryn Elliott Pullins, from the board of directors of
the AVPOA. Recently, he denied the AVPOA's attempts to avoid
trial in this matter and the question whether members of the
association were entitled to have access to financial information.
In a blistering 31 page opinion, the Court restated that factual
issues still remain regarding Mrs. Pullins removal and our efforts to
open the books of the AVPOA. Unless the AVPOA board decides to
settle, we will go to trial on these remaining matters on November 20,
2006 at 10 am.
Any normal defendant would have already have settled this issue by
now. However, the members of the AVPOA have little say on how
their millions in mandatory member dues are spent each year. In
fact, we estimate that the AVPOA will likely spend over $250,000 in
attorney fees and costs alone before this is all over.
